Tarifvertrag

In Nordrhein-Westfalen gelten für bestimmte Wirtschaftszweige sowie einzelne Unternehmen zum Teil Lohn-, Gehalts- und Entgelttarifverträge oder Manteltarifverträge.

Tarifverträge richten sich nach dem jeweiligen Wirtschaftszweig sowie den Arbeits- und Qualitätsanforderungen. Die Vergütungsgruppen sind demnach nicht nach konkreten Berufs- und Tätigkeitsbezeichnungen geordnet, sondern variieren je nach Komplexität der Tätigkeit, Verantwortung und beruflicher Erfahrung.

Collective Labour Agreement (CLA)

A collective agreement is binding for a company if the employer is a member of the Employer Association (Arbeitgeberverbandes), if the applicability of the collective agreement was agreed in the employment contract or – and this is, unfortunately, often overlooked – if a collective agreement has been declared to be generally applicable by the Federal Minister of Economy and Labour (Bundesminister für Wirtschaft und Arbeit). This means detailed clauses are prescribed for employment contracts in companies which belong to those industries and such clauses in some cases go far beyond the legal minimum standards.
